I was a reporter for close to 17 years at the Hawaii Tribune-Herald until October 2005, when I joined the growing ranks of union leaders now formerly employed by the newspaper. Will Higa survive costly sex scandal?

 Will taxpayers be the only ones held accountable?

Yesterday's headline in the Hawaii Tribune-Herald, while not entirely accurate, will certainly hurt Councilman Stacy Higa's reputation and credibility, but the substance of the story should send his mayoral campaign careening right off its rails.

The headline assigned all the blame to Higa when the story clearly indicates there was plenty to go around, from Connie Kiriu to Jimmy Arakaki to the whole boys-will-be-boys culture of county government.

Still Higa is mostly to blame -- his actions set the whole sordid affair in motion -- and if he had a conscience he'd resign from the County Council and quit the mayor's race. But I suspect he's unlikely to do either one.

Higa's "family" attorney, Brian De Lima, provided the boilerplate denial of wrongdoing that is almost as damning as admitting culpability. It's not "wrong and irresponsible to suggest," as De Lima asserts, that Higa did anything wrong when the complaint itself detailed the allegations against Higa that prompted the judge's reported decision to award the victim in the case $272,000.

The story mentions that the county could appeal but I'm not sure whose interests that might serve. Maybe Higa and Arakaki didn't get a proper opportunity to defend themselves but my understanding is that the hard evidence against Higa is too damaging to go that route despite his public protestations.

It also looks like former Councilman Jimmy Arakaki will get a pass for his role since he's out of office and not a candidate. So if, as expected, the culture that led to this costly scandal  inside County government is not properly addressed, no one will be held accountable except taxpayers.

Does anyone think either Higa or Arakaki will pony up to pay taxpayers back for their transgressions? 

Kudos to Cameron Johnson for getting the story. The secrecy surrounding taxpayers being billed for this kind of county "service" is contemptible and needs to be aired.

The judge in this case has sealed the records due to privacy concerns, but the complainant has been named and everyone knows the charges were of a sexual nature. Not only was Mr. Higa way out of line, but so were some important elements of the County apparatus. Does the complainant's right to privacy trump the public's right to know just how dirty our public officials can be when said privacy has already been compromised? I suppose she has suffered enough, and I fully recognize the trauma she has been through, so maybe I just need to accept the fact that we may be lucky to know as much as we do. (The anonymous source for the HTH story would only tell so much.) But all this begs the question of just who did exactly what and how far they went to silence this woman. It all stinks beyond belief and sounds almost criminal. Attorney DeLima's protestations did at least provide some comic relief as long one is willing to accept absurdity as humor.

Higa's reputation as a brutish bully remains untarnished and, in fact, continues to grow.

If only.

This outcome certainly can be interpreted as a smear on the whole of County government. That would not be justice served.
It is true that none of the 3 culpable individuals will bear any personal financial responsibility.
Higa, the 'Big Daddy' of the bunch, may see his political ambitions ended. For example, it gets hard to imagine -- as happened in 2006 -- seeing Higa again swooshing through the County building in stride with US Congresswoman Hirono.

Perhaps, at least, this will give other victims more courage to speak up when subject to such behavior.

It's an understatement to say the HTH may get the facts wrong. To destroy a mans career on hearsay is both foolish and ignorant. It is also the specialty of the HTH. Having been the victim of the HTH which reported charges before any investigation was held,is par for their course. They even are stupid enough to re-report the error after they themselves retracted the story. Judge Mr Higa on his actions not on hearsay.It is my understanding he is not even the defendant. So now collateral damage is an HTH tool I guess.

The 'defendant' is the County, and Mr Higa is the one named as initiating acts; Mr Arakaki and Ms Kiriu for their actions in support of Higa. This was established months ago, including here at hunterbishop.com. Not hearsay.

Judge Mr Higa on his actions? Having been a co-worker of the victim in this case at the time of the harassment, that is pretty much what I am doing.

It amazes me that despite the crystal clear connection Stacy Higa has with these sexual harassment allegations and having now essentially been found guilty of these allegations, that people continue to allow his signs in their yards and businesses. It also amazes me how Stacy Higa can waste the time and money of his supporters being that he has no chance in hell of winning anything but "Biggest Ego in Hawaii County". He has shamed himself, his family, his community and his supporters. Does he think we are all that stupid..........I guess so...............BTW.. Do we know if this is the final judgement or could there be more to come?

I do not always find Weatherford and I on the same page, But he is right. This case is far beyond the suspicious or accusatory stage. It is much like Tribune-Herald being found guilty of a dozen or so illegal labor acts against its employees.

An administrative law charge is much more than a justice of the peace or a District Court judge in Hawaii who arraigns folks. He is a sitting federal judge who hears evidence and examines witnesses and comes up with a conclusion that usually sticks. Until there is a reversal, I consider the conclusion as speaking pounds of truth.

This simply is not analogous to the Brian Jordan-Waiakea High issue.

Corporation council Udovic claims "the county cannot respond to any questions concerning the case", and nobody else will comment, except Mr. DeLima. Taxpayers should be outraged that this warlord style conduct is going to be swept under the rug. The County should re-examine the issue, and try to collect from the "witness(es)" responsible for this pilau mess.

okay wait,"anonymous Hilo" let me get this straight. There's more people putting up his signs all over the place and he has no chance in hell of winning? haha. There are his signs everywhere in Hilo, as well as the rest of the island. Obviously he has much support throughout the whole island. stacy knows the issues plaguing this island and he has very viable solutions to them. He's not one to only talk about what can be done. He knows how to get them done. He's a doer and a leader. One who we need on this island considering the past executives. And that's why I'll still vote for him and gather as many people as I can to vote for him. so don't worry. I'm sure you'll see a lot more signs going up.

Why is Higa still in office? Maybe its just be, but if he truly cared about the people of Hilo, should he not resign? I also agree that Chang should have received more for what she likely went through. Kid me not, Higa is not an attractive person and to think of him hitting on cute Ms. Chang, reminds of the Austin Power's movie with the character "Fat Bastard" who was absolutely repulsive.

Mr. Higa, if you really care about the people of Hilo then RESIGN now!!

This also amazes me how banners continue to pop up around Hilo and possibly the island. Are supporters telling people that this will be appealed and reversed and everything will be fine cause it was all a lie? A federal judge has ruled against him, the evidence must have been there. By continually putting up banners & signs this is not only a slap in the face to Ms.Chang but also to the judge and people of the Big Island. The belief that by putting more banners up to show his support is ludicrous. What this does show everyone is how arrogant and a bully he is.

If he truly meant when he said he found God then he would do the right thing and walk away. He would apolologize to his constituents, supporters, friends, residents of the Big Island, and most importantly his family. Its time to put his pride aside for once and own up to the mistakes.

Anyone. Will this case ever become public record since its public funds being used? Hard Working Taxpaying Funds?

Who you trying to convince?! Or are you just trying to rationalize your support for Higa.

The only support Higa has is those he promised something to (which sounds like you), he owes something to (and they hoping they can collect), those he bought using our taxpayer discretionary fund, and finally,those he mislead.

Can you imagine the damage he could do to our Island if left in power in ANY elected office?....look at what he has already done to the people's trust in the short 3 years he has been in office.

The only thing Higa has proven to this community is that he is a power hungry, slime bag, trouble maker, and incapable of being trusted.

Looking at his face and name makes me sick. Putting up more signs and banners will only fuel resentment and prove what an arrogant egotisitical fool he is.

Higa is toast!

wow, so much anonymous hate comments. Kinda seems like the same person to me. It probably is. But that's okay. everyone has a right to be nuha for any reason. But, like I'll say again, in MY opinion, I still think he's the best man for the job.

it is right that you speak up for whom ever you support.
if you gave good reasons, it would probably help to make it understood why you do support Stacy Higa for Mayor.

do not underestimate the amount of animosity -- right or wrongly -- that Stacy Higa has generated during his time on the Council.

repeated episodes of the same behavior pattern:
aggression toward and exploitation of his position of formal authority and power over those vulnerable to that authority and power... coincidence? or classic?

To make it plain and simple. He was founded guilty and has to pay the fine, NOT the people. Higa is not a king or any chance of high royalty in these islands, so does not give him any right to pick into my pocket or any one else's for that matter. I think he should resign from county or get fired because if you did do that at another job you would be out the door in a heart beat. In the end he should pay the bill not the tax payers!!
